There is no single sticker price for surrogacy in India, and that surprises many couples. The reason is legal. Because the Surrogacy (Regulation) Act 2021 bans any commercial fee to the surrogate, what you pay is not a package for a baby. What Pushes Your Surrogacy Cost Up or Down

  1. Number of IVF cycles. If the first cycle does not yield a usable embryo, a repeat cycle adds significantly to the total.
  2. Failed transfers. The law permits up to three surrogacy attempts, and each additional transfer raises the cost.

Surrogacy Cost in Delhi

Delhi, like other metro cities, tends to sit toward the higher end of the range, mainly because of its advanced embryology laboratories and senior medical teams. The legal costs, insurance, and reimbursement rules, however, are the same nationwide, since they are set by central law rather than the clinic. The Legal Side: Surrogacy Law in India

Surrogacy in India is governed by the Surrogacy (Regulation) Act 2021, its 2022 Rules, and later amendments. Only gestational, altruistic surrogacy is allowed. Paid, or commercial, surrogacy, in which the surrogate receives a fee, is outlawed entirely, as is the older traditional form where the surrogate's own egg is used.

One recent change is worth knowing. Since a February 2024 amendment, intended parents may use one donor gamete, a donor egg or donor sperm when a District Medical Board certifies that it is medically necessary. Eligible single women must use donor sperm alongside their own egg.

Eligibility for Intended Parents

The law treats surrogacy as a medical last resort, so the criteria are strict. A couple generally qualifies when:

  1. Both partners are Indian citizens
  2. They have been married for at least five years
  3. The wife is aged between 23 and 50, and the husband between 26 and 55
  4. They have no surviving biological child, with narrow exceptions for serious illness or disability
  5. A medical condition makes carrying a pregnancy impossible or unsafe

Eligible single women, specifically widows and divorcees between 35 and 45, may also apply. The current law excludes foreign nationals and NRIs, single men, same-sex partners, unmarried couples, and those in live-in relationships. Because eligibility rules have been amended more than once, anyone unsure of their status should confirm it with a specialist.

Who Can Act as a Surrogate

The Act also sets firm conditions for the surrogate, designed to protect her from exploitation. She must be:

  1. Someone closely related to the intended parents
  2. An ever-married woman in the 25 to 35 age band
  3. Already a mother, having borne at least one child who is alive
  4. Taking on the role no more than once across her lifetime
  5. Cleared as medically and psychologically fit through assessment

She cannot contribute her own egg, must give written informed consent, and may withdraw that consent at any point before the embryo is implanted.

Mandatory Insurance for the Surrogate

A point that catches many intended parents off guard is the insurance requirement. You are legally obliged to provide the surrogate with health insurance for 36 months, taken from an IRDAI-recognised insurer, covering the pregnancy, delivery, and any postpartum complications. This is not optional, and it is a real line in your budget.

Legal Parentage of the Child

Under the Act, a child born through surrogacy is recognised as the biological child of the intended parents from the moment of birth, with full legal rights. The surrogate has no parental claim, and the intended parents cannot disown the child. These protections only hold when the agreement and certificates are completed correctly beforehand, which is why the legal groundwork matters as much as the medical care.

Penalties for Breaking the Law

The Act is enforced with serious penalties. Commercial surrogacy, abandoning the child, exploiting the surrogate, or advertising for one can attract imprisonment of up to ten years and a fine of up to Rs 10 lakh.
